4. General Terms of Use
- You agree to use our services only for lawful purposes.
- Unauthorized use, tampering, or abuse of our services may result in suspension or termination.
- All products are sold with a standard manufacturer's warranty as outlined in your purchase agreement or product documentation. This warranty covers defects in materials and workmanship under normal use.
- Except as expressly provided in the applicable warranty, Big Star Power disclaims all other warranties, express or implied, including but not limited to merchantability and fitness for a particular purpose.
4.1 Product-Specific Legal Agreements (Warranty and EULA)
Your purchase, installation, and operation of physical hardware units, as well as any software or embedded firmware provided by Big Star Power, are subject to additional specialized agreements incorporated into these Terms by reference:
- Limited Warranty Policy: Physical hardware products manufactured or supplied by Big Star Power (including but not limited to Hydro Racks, Immersion Racks, Smart PDUs, Industrial Transformers, and Containers) are governed exclusively by the Big Star Power Inc. Limited Warranty Policy provided with your purchase agreement or product documentation. The Limited Warranty Policy controls all hardware defect claims, Return Merchandise Authorization (RMA) procedures, maintenance conditions, and physical coverage exclusions.
- End-User License Agreement (EULA): All software and custom firmware, including Big Star Power custom firmware and AMS software ("SOFTWARE"), are licensed, not sold, pursuant to the Big Star Power End-User License Agreement. The EULA governs software licensing, operational limitations, and intellectual property rights.
Except as expressly provided in the applicable Limited Warranty or EULA, Big Star Power disclaims all other warranties, express or implied, including but not limited to merchantability and fitness for a particular purpose. In the event of a direct conflict between these Terms and either the Limited Warranty or the EULA regarding their specific subject matter, the terms of the Limited Warranty or EULA shall control.
5. Website Content
The Site describes Big Star Power and its infrastructure capabilities for general information. Content may change without notice. Site descriptions of capacity, sites, equipment, pricing, schedules, and availability are informational and create no binding offer or commitment; commercial terms exist only in executed written agreements. Site availability is subject to change.
5.1 No Offer of Securities
Nothing on the Site is an offer to sell or a solicitation of an offer to buy any security. Any investment materials are provided separately, only to persons qualified to receive them, and any offering is made solely through its own offering documents.
