This Privacy Policy describes how Big Star Power Inc. ("Big Star Power," "we," "us," or "our") collects, uses, discloses, and protects personal information in connection with our website at bigstarpower.ai (the "Site"), our business communications, and our SMS messaging program. Big Star Power is a power and digital infrastructure company headquartered at 240 Centre Drive, Burleson, Texas 76028.
By using the Site or providing information to us, you acknowledge the practices described in this Privacy Policy and our Terms of Service. If you do not agree with this Privacy Policy, please do not use the Site or submit information to us.
1. Scope
This Privacy Policy applies to personal information we collect through the Site, through forms, email, phone, and SMS communications, and through our business interactions with prospective customers, partners, suppliers, landowners, and other business contacts. Separate customer agreements, investor platforms, and employment relationships may be governed by their own privacy notices or contract terms, which control where they apply.
2. What Is Personal Information
"Personal information" means information that identifies, relates to, or could reasonably be linked with an identifiable individual. It excludes information that has been de-identified or aggregated so that it can no longer reasonably be linked to an individual.
3. Personal Information We Collect
We collect only the personal information reasonably necessary for the purposes described in this Privacy Policy.
3.1 Information You Provide
- Contact and professional details, such as your name, company, job title, work email address, and phone number.
- Request details you submit through Site forms, such as the type of request, IT load, region, target energization date, cooling approach, site or property information, and the content of your messages.
- Investor inquiry details, if you request investor materials, including your contact information and your representation of accredited investor status.
- Communications you send us by email, phone, SMS, or social media.
- SMS opt-in records, including your mobile number and your consent to receive messages.
3.2 Information Collected Automatically
- Technical information, such as your IP address, browser type, device information, referring page, and the pages you visit, recorded in standard server logs by our hosting provider for security and operations.
- The Site page from which you submitted a form, and the campaign, ad, or link that brought you to the Site, including ad click identifiers.
- Information collected through cookies, pixels, tags, and similar technologies, from us and from our analytics and advertising partners, such as the pages you view, the links you click, the time you spend on the Site, and whether a visit leads to a form submission or call. Section 4 explains these technologies and your choices.
3.3 Information From Other Sources
We may receive business contact information from publicly available sources, industry events, professional networking platforms such as LinkedIn, and business partners and referral sources.
4. Cookies, Analytics, and Advertising
4.1 What We Use
We use cookies and similar technologies in three categories. Strictly necessary technologies deliver and secure the Site and remember your choices. Analytics technologies help us understand how visitors find and use the Site. Advertising technologies help us measure how our ads perform and show our ads to people who have visited the Site when they use other websites, apps, and platforms.
4.2 Our Analytics and Advertising Partners
Depending on your choices, the following partners may collect information through the Site using their own cookies, pixels, or tags: LinkedIn (the LinkedIn Insight Tag), Meta (the Meta Pixel), Google (Google Analytics and the Google Ads tag), X (the X Pixel), and HighLevel (our CRM provider's website tracking, which connects your visits to the Site with any information you submit through our forms). These partners may combine this information with other information they hold about you and use it under their own privacy policies.
We may also share contact information you have given us, such as an email address, with advertising platforms such as LinkedIn, Google, Meta, and X, usually in hashed form, so that we can show our ads to existing contacts, find people with similar professional profiles, or exclude existing contacts from our ads. The platforms use this information only to match it to their own users.
4.3 Your Choices
On your first visit, a banner lets you accept all cookies or keep necessary cookies only. Outside Europe, analytics and advertising cookies are on unless you choose necessary only; in Europe they stay off unless you accept all. You can change your choice at any time with the Cookie settings link in the Site footer.
If your browser sends a Global Privacy Control signal, we treat it as a request to opt out of analytics and advertising cookies and of the sale or sharing of your personal information for targeted advertising. Browsers' Do Not Track signals have no common standard, and we do not respond to them.
You can also manage ads through the platforms themselves: Google My Ad Center (myadcenter.google.com), Meta Ad Preferences (facebook.com/adpreferences), LinkedIn Advertising Preferences (linkedin.com/psettings/advertising), and the ads settings in your X account, and through the industry opt-out tools at optout.aboutads.info and optout.networkadvertising.org. Blocking or deleting cookies in your browser also limits these technologies, though some Site features may not work as intended.
5. How We Use Personal Information
We use personal information to:
- Respond to your inquiries and requests, including site match, site sheet, briefing, dossier, quote, and investor material requests.
- Evaluate potential business relationships and prepare proposals, site matches, and commercial terms.
- Deliver products and services, manage projects, and provide customer support.
- Send transactional and informational communications, and marketing communications where permitted by law or with your consent.
- Operate our SMS messaging program for subscribers who have opted in.
- Measure the performance of our advertising, and show our ads to people who have visited the Site or who match our business audience, consistent with your choices under Section 4.
- Operate, maintain, secure, and improve the Site, including detecting and preventing fraud, spam, and abuse.
- Comply with legal, regulatory, tax, and accounting obligations, and establish, exercise, or defend legal claims.
We do not use personal information for automated decision-making that produces legal or similarly significant effects.
6. How We Share Personal Information
We do not sell personal information for money. We share personal information only as follows:
- Service providers: companies that support our operations under contractual confidentiality obligations, including website hosting, customer relationship management, communications and messaging, email, and internal collaboration tools. They may use personal information only to provide services to us.
- Affiliates: our subsidiaries and affiliated companies, including BiXBiT USA Inc., for the purposes described in this Privacy Policy.
- Business partners: engineering, construction, equipment, and utility partners, where necessary to evaluate or deliver a project you have requested, and subject to confidentiality obligations.
- Analytics and advertising partners: when you allow analytics or advertising cookies, the partners listed in Section 4.2 receive information about your use of the Site through their technologies, and advertising platforms may receive contact information as described in that section. Under some state laws, including California's, this may be considered a "sale" or "sharing" of personal information for cross-context behavioral advertising, or processing for "targeted advertising." You can opt out at any time as described in Section 4.3.
- Legal and safety reasons: when we believe in good faith that disclosure is reasonably necessary to comply with law, regulation, legal process, or a governmental request; to enforce our agreements; to detect or prevent fraud, security, or technical issues; or to protect the rights, property, or safety of Big Star Power, our users, or the public.
- Corporate transactions: in connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business or assets, in which case personal information will remain subject to protections consistent with this Privacy Policy.
- With your consent: in any other case where you direct or permit us to share it.
6.1 SMS and Mobile Information
Mobile phone numbers, SMS opt-in data, and consent records are never shared with third parties or affiliates for their marketing or promotional purposes. This information is shared only with service providers that operate our messaging program on our behalf. Text-messaging originator opt-in data and consent are excluded from all other sharing categories described in this Privacy Policy, including the analytics and advertising sharing described in Sections 4 and 6.
7. Data Retention
We keep personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including maintaining an active or prospective business relationship, and as required to meet legal, regulatory, tax, accounting, and dispute-resolution obligations. When personal information is no longer needed, we delete it or de-identify it. Our analytics and advertising partners keep the information their technologies collect under their own retention policies.
8. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, alteration, disclosure, or destruction, including encryption in transit and access controls on the systems that store it. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Your Privacy Rights
Depending on where you live, and subject to applicable law, you may have the right to:
- Confirm whether we process your personal information and access a copy of it.
- Correct inaccuracies in your personal information.
- Delete personal information you provided or that we obtained about you.
- Obtain a portable copy of your personal information.
- Opt out of the sale or sharing of personal information, targeted advertising, or profiling. You can opt out of the sale or sharing of your personal information for targeted advertising with the Cookie settings link in the Site footer, by enabling Global Privacy Control in your browser, or by contacting us.
- Withdraw consent where our processing is based on consent, including consent to marketing communications.
To exercise these rights, email info@bigstarpower.ai with the subject line "Privacy Request" or write to us at the address below. We will verify your identity before fulfilling a request, and we will respond within the time required by applicable law. You may use an authorized agent where the law permits, and we may request proof of the agent's authority. We will not discriminate against you for exercising your privacy rights.
9.1 Appeals
If we decline to take action on your request, you may appeal our decision by replying to our response with the subject line "Privacy Appeal." We will inform you in writing of the outcome of your appeal and the reasons for it. If your appeal is denied, you may contact the attorney general of your state of residence, including the Texas Attorney General at texasattorneygeneral.gov.
9.2 Texas Residents
Texas residents may have rights under the Texas Data Privacy and Security Act, including the rights described above and the right to opt out of the processing of personal data for targeted advertising. Big Star Power does not sell sensitive personal data.
9.3 California Residents
To the extent the California Consumer Privacy Act, as amended, applies, California residents may have the rights described above, including the right to know the categories of personal information we collect, the sources, the purposes, and the categories of recipients, as described in Sections 3 through 6, and the right to opt out of the sale or sharing of personal information. When you allow advertising cookies, we disclose identifiers, such as IP address, cookie identifiers, and ad click identifiers, and internet or other electronic network activity information, such as pages viewed and form submissions, to the advertising partners described in Section 4.2. This may be considered sharing for cross-context behavioral advertising. We do not sell or share personal information for money, and we do not knowingly sell or share the personal information of anyone under sixteen. We do not use or disclose sensitive personal information for purposes that would give rise to a right to limit its use. Under California Civil Code Section 1798.83, California residents may request information about disclosures of personal information to third parties for their direct marketing purposes; we make no such disclosures.
9.4 Marketing Communications
You may opt out of marketing emails at any time by using the unsubscribe link in the message or by contacting us. You may opt out of SMS messages at any time by replying "STOP." We may still send non-marketing communications related to an active business relationship.
10. Children's Privacy
The Site is intended for business audiences and is not directed to individuals under the age of eighteen. We do not knowingly collect personal information from anyone under eighteen. If you believe a minor has provided personal information to us, contact us and we will delete it.
11. Third-Party Websites
The Site may contain links to websites operated by third parties, including our affiliates' websites and professional networking platforms. Their privacy practices are governed by their own policies, and we encourage you to review them before providing any information.
12. International Visitors
Big Star Power is based in the United States, and personal information we collect is processed and stored in the United States. If you access the Site from outside the United States, you understand that your information will be transferred to, processed, and stored in the United States, where data protection laws may differ from those in your jurisdiction.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The effective date at the top of this page reflects the most recent version. If we make material changes, we will provide more prominent notice on the Site. Your continued use of the Site after an update constitutes acknowledgment of the revised Privacy Policy.
